TN Moves SC Against Prez's Reference Over Assent to Bills

AFTER Kerala, Tamil Nadu government on Monday filed a plea in the Supreme Court requesting it to return the reference made by President Droupadi Murmu seeking the apex court's opinion on matters relating to the timelines for granting of assent to Bills by Governors and the President.

The reference is "headless and devoid of merits," TN said.

"The reference has been issued to overrule the decision and directions of this court in the State of Tamil Nadu vs. Governor of TN judgment and it is nothing but an appeal in disguise, which is impermissible in law as this court has no power to overrule its own judgments under Article 143," the application filed by senior advocate P Wilson said.

"Currently, no review or curative petition has been preferred by the Governor of Tamil Nadu against the judgment," the state said.
