The Rising Threat of Deepfake Crimes: The Need for Stringent Legal Safeguards in India

The legal framework of India is not at par to raise a voice against the complexities of deepfake crimes. On the other hand, our nation has enacted certain laws, like the Information Technology Act, 2000, and the Bharatiya Nyaya Sanhita, 2023, involving sections for privacy concerns and defamation.
Deepfake technical setup is being driven by the essence of artificial intelligence (AI), which has evolved into a double-edged sword in this technological generation. Since it represents inventions and innovation in audio and visual media, its frivolous usage has raised concerns about its privacy, misuse of information, and cybersecurity crimes.
As we all know that in India, the digital penetration is widening, and the fear of deepfake crimes is on the verge, thus, it demands necessary and immediate legal standards and regulations. According to the data, India has witnessed a surge of 550% in deepfake cases since 2019 alone. In 2024, over a million deepfake videos were uploaded, and there are around more than 50 applications that can be used to generate these types of videos.
