Government service litigation often turns on a deceptively simple question:
If you were eligible, were you entitled?The Punjab and Haryana High Court's answer—consistent with Supreme Court doctrine—draws a sharp line between a right to be considered for promotion and a right to promotion itself.
In Poonam Rani v. State of Punjab (and others), the High Court held that promotion is not a fundamental right, even where an employee satisfies eligibility conditions. The Court restated a principle that has repeatedly surfaced in service jurisprudence: what Article 16 protects is equality of opportunity, which translates into a legally enforceable expectation that the administration will consider eligible employees fairly and non-arbitrarily—typically through a duly convened Departmental Promotion Committee (DPC) and a process that applies the rules uniformly.
