Health board expert ‘couldn't rule out’ effort to mislead

- By David Walker Scottish Politics Reporter

Trans doctor's phone evidence may have been tampered with

DR BETH Upton’s phone “wasn’t properly examined”, it has been claimed, as concerns were raised about notes he said he had taken “contemporaneously”.

IT forensics expert Jim Borthwick was called to give evidence at the Sandie Peggie tribunal after being hired by her legal team to scrutinise notes made by the trans medic.

It has been claimed so far at the tribunal that Dr Upton took notes on his mobile about incidents between him and Ms Peggie, who is suing both him and NHS Fife after being forced to share the female changing room with the biological man.

These included details about alleged patient safety incidents which have been unproven so far.

Mr Borthwick explained his report found that some of the screenshots of the notes taken by Dr Upton had different dates on them than when he said they were written.

His explanation was synchronisation issues on Google, but this was questioned by the expert. Even NHS Fife’s own IT expert couldn’t find a reasonable explanation for the differentials between the dates, admitting that there is a “possibility” they had been manipulated to be “misleading”.
