DRINK-DRIVING PROSECUTIONS MAY BE RESCINDED DUE TO COURT RULING

THOUSANDS of drink-driving prosecutions could be rescinded after a court ruled there is a problem with the legal system's blood and urine test regime.

The shock possibility of throngs of overturned convictions has resulted from a case of a man who was found guilty of drink-driving and got a two-year ban.

His solicitor claimed the verdict should be overturned due to an inability to prove that his blood sample could not have been tampered with after the arresting garda posted it for analysis.

A judge agreed, overturned the driver's conviction and driving ban, and ruled that the law is flawed and said it is up to the State to address it.

The Director of Public Prosecutions is expected to challenge the court ruling after the judge's ruling takes effect next month.
