HC revokes Pocso charges against 10-yr-old's mother

The Delhi high court has quashed criminal proceedings against a mother who failed to immediately report the sexual assault of her 10-year-old daughter by the girl's father and cousins, ruling that societal pressures and trauma must be considered before prosecuting delayed reporting under the Protection of Children from Sexual Offences (Pocso) Act.
NEW DELHI:
In a judgment delivered on April 21, made public Tuesday, justice Swarana Kanta Sharma set aside a trial court order that had framed charges against the 35-year-old mother under Section 21 of the Pocso Act, which mandates reporting of sexual offences against children.
The court held that the provision should not be applied mechanically against family members who delay reporting due to fear, trauma or social stigma.
