New provisions in Mental Health Act - change explained

The Mental Health Act has introduced new provisions which deal with patients who are subject to conditional discharge. This new aspect of law came into effect on February 18, 2026.

Prior to this amendment, the tribunal could not conditionally discharge a patient with conditions that would amount to a deprivation of liberty. However, the law has now changed to allow such a condition under certain circumstances.
