THE Court of Tax Appeals (CTA) has barred the Bureau of Internal Revenue (BIR) from collecting P849.14 million from Eastern Petroleum Corporation representing its supposed deficiency taxes for taxable year 2014.

In a 16-page decision, the CTA’s Special Second Division held that the tax assessments issued by the BIR against Eastern Petroleum are “invalid” due to its failure to provide the due dates for the payment of the subject deficiency taxes.

The tax court upheld the oil company’s argument that the final assessment notice (FAN) issued by the BIR is void for being violative of its right to due process.

The petitioner pointed out that it received the formal letter of demand (ELD) and FAN on October 24, 2019 but was issued on October 22, 2019.

The FLD and FAN indicated a due date of September 30, 2019 for payment of the deficiency taxes.
