In his affidavit, Alcover cited "willfully, unlawfully, and with manifest partiality" as grounds for the complaint, derived from alleged "evident bad faith and gross negligence.

The same affidavit argued that there had been an alleged "conspiracy" in the unauthorized establishment, management, and operation of this year's Colon Street Night Market.
Alcover said this has converted a public street into a private commercial venture, in the absence of legal qualification or public bidding. "Their collective acts reflect a pattern of deliberate concealment, misuse of authority, and betrayal of public trust," he said.
RETRACING ALCOVER ARGUMENTS
As he has repeatedly claimed, Alcover brands the current operation as a "black market" that hides alleged illegality behind the semblance of public service.
In his affidavit, Alcover reiterated that the Colon Street Night Market 2025 was permitted to operate by the Cebu City Government under a special permit issued to a private organizer by the Cebu City Business Permit and Licensing Office (BPLO). It was also covered by the authority of the mayor, he said.
