ABC Cement Limited manufactures cement and has hired XYZ Agency to handle the loading, delivery etc. of cement.

Some of the retired workers of XYZ Agency were not paid overtime wages. They have filed a claim against ABC Cement Limited for such payment. Is ABC Cement Limited liable for overtime wages to employees of XYZ Agency?
Yes, ABC Cement Limited shall be liable to make such payments. According to section 21(4) of the Contract Labour (Regulation and Abolition Act) 1970, if the contractor fails to make payment of wages within the prescribed time, or, of the desired amount, then the principal employer is liable to make such payments. ABC Cement Limited is liable to pay overtime wages to the contract labourers, and, can recover the amount paid by them from XYZ Agency either from any amount payable to the XYZ Agency under a contract, or as debt payable by XYZ Agency.
