Driver avoids jail after tragic death of aunt in road accident

Sheriff imposes ban as alternative to prison

A former Royal equestrian instructor who drove over and killed his aunt in his pick-up truck has been allowed to walk free from court.

Andrew Dewar-McCabe was previously found guilty by a jury of causing 69-year-old Jackie Gadd’s death by knocking her down and dragging her under his vehicle near the village of Kinloch Rannoch, in Perthshire, in June 2022.

Dewar-McCabe, who served for 15 years and was an instructor at Sandhurst Royal Military College, was banned from driving for 18 months and ordered to re-sit the extended driving test. He was also told to complete 150 hours unpaid community work.

At Forfar Sheriff Court, on Thursday, April 24, Sheriff Jillian Martin-Brown said: “This was a tragic accident and an isolated incident, which led to the tragic death of your aunt.

“You have expressed considerable remorse. I take into account the trauma which was experienced by those who witnessed it.

“You were found guilty of failing to maintain proper observations when you couldn’t see behind the vehicle. It amounts to more than momentary inattention.

“However, there was no suggestion of drink, drugs, tiredness, distraction, speeding or driving aggressively on your part. After careful consideration, I have decided an alternative to custody is available.”

She said it was clear from the family's victim impact statements that Mrs Gadd’s death had caused a severe emotional and psychological impact on her close relatives and partner.
