Mr M was the captain of a ship that was moored in a tidal harbour and he was alone when it became necessary for him to trim the engine. This is a task that is necessary due to the tidal nature of the vessel's berth and involves tilting the engine.

Unfortunately, there was an ongoing issue with the engine of the boat which meant that the mechanism to perform the tilt was not fully operational. This resulted in
