Special Elections Don't Require Congress Resolution

The Supreme Court has ruled that the Commission on Elections (Comelec) can hold special elections for vacant congressional seats without a resolution from Congress.

The SC has affirmed the independent authority of the Comelec to call special elections as it dismissed the petition filed by Elroy John Hagedorn, who had sought to compel the House of Representatives to officially declare a vacancy in the third legislative district of Palawan and call for a special election.

The seat became vacant following the death of Rep. Edward Hagedorn in October 2023, who was elected in 2022.
