The Home Office must reconsider the case of a woman who was denied indefinite leave to remain (ILR) in the UK despite her brothers and father being given the status under the Windrush scheme, court of appeal judges said yesterday.

Jeanell Hippolyte had challenged a high court decision not to ask officials to review a decision to deny her application for ILR.

Lord Justice Singh, Lady Justice Andrews and Sir Andrew McFarlane said the high court judge had fallen into error, and allowed the appeal against the decision made last November.

Singh said: "It seems to me the judge nowhere addressed the core point which the appellant was making to the respondent, which was that she had sufficient close ties to the UK that she fell within the 'spirit' of the Windrush scheme even if she did not strictly fall within its exact terms."
