Supreme Court: If parties attempt to obtain by trick, courts can impose cost for vexatious litigation

The court stated that, 'If the parties misuse the process and attempt to obtain an order by 'trick and stratagem.'

The Supreme Court in the case Leelawati (Dead) Thr. Lrs. Versus State Of U.P. And Ors criticized a litigant for filing multiple petitions filed before the High Court wherein the applicant hides the dismissal of an earlier petition.

The court in the case observed and has imposed of cost and increased the penalty for an amount to Rs 50,000, wherein the court emphasized that such measures are essential to deter frivolous and vexatious litigation.

The court stated that, 'If the parties misuse the process and attempt to obtain an order by 'trick and stratagem.'

The court observed that, 'The court would be justified in imposing the costs for igniting such vexatious litigation.'

The bench comprising of Justice JK Maheshwari and Justice Aravind Kumar was hearing the present matter.

The bench in the case was hearing the matter where the Appellant had preferred an appeal against the decision of Allahabad High Court, wherein the court dismissed a petition filed by him with a cost of Rs. 20,000/- for filing a vexatious petition.
