No spl courts, all bail: SC

At a time when Indian courts are buckling under an unprecedented weight with the total number of pending cases across high courts and subordinate courts surging past the five crore-mark by the end of 2024, the Supreme Court has come down heavily on the Centre for its failure to set up special courts for NIA and other statutes.

The top court observed that no effective measures have been taken by the government to conduct expeditious trials in matters being investigated under special laws such as UAPA. The apex court warned that courts will have to grant bail to NIA and UAPA accused if dedicated courts are not setup for speedy trial of such cases

New Delhi, July 18: The Supreme Court Friday pulled up the Centre and Maharashtra government for not creating courts for cases under special statutes concerned that courts will be forced to grant bail to accused.
The order of a bench of Justices Surya Kant and Joymalya Bagchi said, "If the authority fails to establish courts with requisite infrastructure for conducting speedy trial under the NIA Act and other special statutes, the court would invariably be forced to release the accused on bail, as there is no effective mechanism to conclude the trial in time bound manner."
