Dismisses Appeal In ReT Appointment Row

Srinagar: The High Court of J&K and Ladakh on Tuesday dismissed an appeal challenging the appointment of a Rehbar-e-Taleem (ReT) teacher in Budgam, holding that when a civil court has jurisdiction to try a Suit, it cannot convert its writ jurisdiction into that of a civil or appellate court.

A Division Bench of Justice Sindhu Sharma and Justice Shahzad Azeem upheld the earlier decision of the writ court, which had declined to interfere with the appointment order issued in favour of one M M Mir in 2011.

The appeal was filed by W Y Khan, who had challenged Mir's appointment as ReT teacher at Upgraded Primary School, New Colony Ompora in Budgam. She alleged that Mir secured the post using forged documents and was not a genuine resident of the locality, a mandatory requirement under the ReT scheme.
