Misuse of dowry law is on the rise, laments Delhi HC

The Delhi high court has expressed concern about some women harassing their husbands and in-laws by misusing the anti-dowry law — referring to Section 498 A of the Indian Penal Code (IPC), which was replaced by Section 86 of the Bharatiya Nyaya Sanhita (BNS) on July 1, 2024.

The section in question defines the criminal code provisions pertaining to any act likely to drive a woman to suicide or harassment to coerce a woman to meet any unlawful demand for valuables.

A bench of Justice Amit Mahajan made the remarks while quashing a case registered by a wife against her husband under Section 498A in 2017, alleging harassment on the grounds of dowry demand and failure to return her "stri dhan".
