‘Courts must exercise restraint in passing order for CBI probe’

The Supreme Court on Thursday set aside an Allahabad high court decision directing the Central Bureau of Investigation (CBI) to probe alleged irregularities in staff recruitments in the Uttar Pradesh legislative assembly and council, and advised constitutional courts to exercise “judicial restraint” in passing such directions.

The top court order came on an appeal filed by the Uttar Pradesh government and the UP legislative council challenging the high court order of September 18, 2023 that had ordered a probe into appointments to various posts in the legislative bodies in 2020.
