Only legal heirs responsible for care of senior citizens

The Kerala High Court has ruled that only legal heirs are responsible for the care and support of senior citizens who do not have children.

A division bench, consisting of justices Sathish Ninan and P Krishna Kumar, issued the ruling in a case involving a woman who was not required to provide support to her husband’s aunt because she did not meet the statutory criteria of a “relative” under the Maintenance and Welfare of Parents and Senior Citizens Act.
The court emphasised that merely possessing a senior citizen’s property does not automatically impose a maintenance obligation on an individual unless they are recognised as a legal heir under the relevant personal laws.
