Can I sue my ex-wife for not letting me visit my children?

I am a Muslim man. A year ago, I divorced my wife, who is also Muslim. The court granted her custody of our children — a five-year-old girl and a six-year-old boy, in addition to monthly expenses. The court ruled that I was allowed to see my children once a week during the day.

However, my ex-wife has not allowed me to see my children for more than four months, claiming that they do not want to see me. She is often absent from home and sometimes spends the night elsewhere. Can I file a law-suit to revoke custody?

According to Article 121 of the new Federal Decree-Law No 41 of 2024 on the Issuance of the Personal Status Law, if a child is in the custody of one of the parents, the other parent has the right to visit according to their mutual agreement. In the event of a dispute, the court decides what it deems to be in the interest of the child. Hence, you have the right to approach the court, which will ensure that your ex-wife lets you visit the kids.
