DEVELOPMENTAL TRAJECTORY OF THE WAQF AMENDMENT ACT

On April 2, 2025, the Central Government introduced the Waqf Amendment Act in Parliament after one-year intensive debate and discussions on the need to improve Waqf property management and governance.
After intensive consultation of more than 12 hours, the Bill was passed in favour of 288 votes and against 232 votes.
The development of Waqf rule in India has been affected by various legal battles and systemic challenges. Two important cases related to Waqf property management highlight the problems of this system. In the case of Imran Qureshi vs. Uttar Pradesh Waqf Board (2016), a social worker revealed illegal sales to private developers of mosque properties in Lucknow. Similarly, in Fatima B vs Karnataka Waqf Board (2022) case, a 70 -year -old woman was evicted from a rented house on Waqf property, as the property was auctioned without any prior notice.
These incidents reflect extensive issues related to Waqf properties, including encroachment, corruption and mismanagement. The need for several legislative amendments was felt to protect the solution of these problems and the basic objective of Waqf properties, resulting in the Waqf Amendment Act passed.
