Government consults on victim access to child sex abusers' super

After stagnating for several years, the government has released draft legislation to prevent convicted child sexual abusers from hiding their assets in superannuation to avoid compensating their victims.
Identical to the January 2023 discussion paper, the draft legislation proposes to enable victims and survivors to access, via a court order, to additional personal or salary sacrifice super contributions made by the offender if compensation remains unpaid after 12 months.
Historically, many offenders have deliberately hidden millions of dollars' worth of assets in superannuation to avoid paying compensation to victims.
