GAUTENG High Court Judge Mandlenkosi Motha became a target of a small group of apartheid apologists and anti-transformation agents within the legal sector when he took issue with the fact that there was not a single black practitioner in a case concerning a challenge to the BEE legislation.

What the honourable judge was troubled with was the fact that an all-white legal team would not be able to fully reflect on the issues that the BEE legislation intends to address.
Further, how could it be accepted that in today’s South Africa, where the majority are black, there was not a single African legal practitioner to take part in this case?
