 That reality moved closer earlier this week when a German consumer rights group, Verbraucherzentrale NRW, failed to secure a court injunction in Cologne to stop Meta Platforms from training its AI with public Facebook and Instagram posts from European users. For the 400 million Meta users in the European Union, this ruling clears the way for the tech giant to begin data collection, sparking debates over privacy and control in the $2 trillion AI industry.
Meta’s plan, set to start soon, allows users to opt out but has drawn fierce criticism for not requiring explicit consent, raising questions about compliance with EU data protection laws.

A state-funded consumer rights group, Verbraucherzentrale NRW, sought an injunction to block Meta from using public posts and user interactions on Facebook and Instagram to train its AI models, arguing it violates EU privacy laws.
The higher regional court in Cologne rejected the request, ruling that Meta’s data processing does not breach European Union regulations.
The court stated that Meta pursues a “legitimate end” by using data for AI training, even without user consent, as the practice aligns with industry standards and offers societal benefits like improved AI services.
 The decision followed Meta’s announcement that it would begin training its AI models with EU user data, notifying users via email and in-app alerts with an opt-out option.
