KERALA High Court has observed that the allegation of rape made after 16 years is prima facie not believable because of the long delay and such relationship is to be considered as consensual.

KERALA High Court has observed that the allegation of rape made after 16 years is prima facie not believable because of the long delay and such relationship is to be considered as consensual.
Justice A Badharudeen issued the order while quashing a rape case against Biju P Vidya of Pathanamthitta. The court noted that the complainant alleged that the petitioner subjected her to rape in the year 2001, and the First Information Statement was given in 2017 only.
