Supreme Court: Court Cannot Postpone Implementation Of Bail Order After Finding Accused Entitled To Bail

The Supreme Court in the case Jitendra Paswan Satya Mitra v. State of Bihar observed and has ruled that once a court concludes that an accused is entitled to bail, it cannot delay the implementation of the bail order, as doing so may violate the rights guaranteed under Article 21 of the Constitution of India.

The bench comprising of Justice Abhay Oka and Justice Augustine George Masih was hearing the present matter.

The bench deleted the condition which is being imposed by the Patna High Court, wherein the court granted bail to an accused that the bail order will be executed after six months. The High Court in an impunged order did not provide any reason for imposing such a condition.

The court held that the impugned judgement proceeds on the footing that the appellant is entitled to bail and in fact the impugned order grants bail.
