AG Sunday joins Coalition objecting to federal moratorium on state regulation, policing of Artificial Intelligence

Attorney General Dave Sunday is once again expressing opposition to federal plans that would preempt state laws regarding artificial intelligence (AI) and its associated risks, particularly the potential harm to children and vulnerable individuals who can be exploited online.

While Attorney General Sunday and some Pennsylvania legislative leaders are actively working to address the safety risks posed by modern technology, the U.S. Congress is poised to pass a provision that prevents states from regulating AI and from taking enforcement actions against those who misuse it.

This week, Attorney General Sunday joined 36 other Attorneys General in sending a letter to Congress opposing the preemption of state laws on this matter. Earlier this year, he was part of a coalition with a similar message.

"I am again joining many colleagues in urging Congress to allow states to continue our significant progress in protecting children, families, and communities from the dangers posed by artificial intelligence," Attorney General Sunday stated. "We are actively pursuing offenders who exploit AI to abuse children and unsuspecting adults by manipulating images and sharing them online an enforcement capability made possible by our state legislature. Our legislative leaders are also working on additional bills to strengthen protections against the harmful use of technology."

Among these proposed bills are:

- SB1050: Mandating the reporting of child sexual abuse material, including artificially generated child sexual abuse material (CSAM).

- HB1925: Concerning the regulation of AI in healthcare.
