I am a tenant in a short-assured tenancy and the lender has repossessed the landlord’s property. Am I still a tenant? Who should I pay rent to, the repossessed landlord or the lender?

Your short tenancy questions answered

Yes, you are still a tenant. The tenancy does not automatically end simply because the landlord loses possession of the property where you reside.

However, your rights depend on two factors: the type of tenancy you have, and whether or not the lender knew about the tenancy and consented to it when the secure loan was given to the landlord.

Where the lender did not consent to the property being rented out, they might seek to evict you.

You shouldn't stop paying rent. Instead, seek clarification in writing about who is now responsible for collecting it. If the lender does not accept the rent, you should continue paying rent to your original landlord, even if the lender may technically now own the property you are renting.
