The Supreme Court Tuesday began hearing a batch of petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025, stating that any request for interim relief must be supported by a “strong and glaring” case due to the presumption of constitutionality attached to laws passed by Parliament.
A bench comprising Chief Justice DY Chandrachud and Justice Augustine George Masih made this observation as senior advocate Kapil Sibal led arguments against the amended law, calling it a “complete departure from historical legal and constitutional principles” and an attempt to “capture waqf properties through a non-judicial process”.
