SC quashes HC order, grants relief to father

HC had stayed bail order issued by magisterial court to Milap Shah, father of the minor whose speeding ear killed a security guard

The Supreme Court on Wednesday quashed an order by the Gujarat High Court that had stayed a magisterial court's decision to grant bail to Milap Shah. Shah's minor son was behind the wheel of a Mercedes that killed a security guard in Bopal on September 14. Police arrested Shah for permit-ting his minor son to drive the vehicle, leading to the fatal accident. The Supreme Court stated, "We are of the considered opinion that such an order could not have been passed at an interim stage without hearing the petition on merits," as it over-turned the High Court's stay.
