RERA lacks authority over redevelopment rent disputes

US-based man's petition rejected against developer of Shivalik Platinum
Gujarat Real Estate Regulatory Authority has ruled it cannot decide rent payment disputes between old property occupants and developers in redevelopment cases. This judgment came after a case involving Shivalik Platinum in Bodakdev.
The ruling sets a key precedent limiting RERA's powers in redevelopment disputes where rental agreements exist between original owners and developers. Many development agreements include rental provisions that now fall outside RERA's scope.
