Court upholds eviction of owner’s cousin who refused to vacate the house lent temporarily

The Gujarat High Court has ruled that a formal written notice is not mandatory for revoking permission to occupy a premises given rent-free for a limited period.

The court upheld the order by Small Causes Court in Ahmedabad to execute a possession warrant and hand over disputed premises to the landlord. Justice J C Doshi dismissed a revision application filed by the occupant against his eviction order.

The landlord had given the property in a society in Ahmedabad to his cousin rent-free for a limited period. When he sought possession back, the cousin refused.
