DRIVEN BY THE resolve that the Central government should not be a compulsive litigant, the Union Ministry of Corporate Affairs (MCA) has taken a decision under its Special Arrears Clearance Drive-II to withdraw another 7,338 prosecutions, which have remained pending before various courts
This is also driven by two additional objectives. The first is to promote 'ease of doing business' and the second to further decriminalise compoundable offences under the Companies Act, 2013. This move will lead to a significant decrease of around 22 per cent in the pending prosecutions being pursued by the Central gov
