THE Sandiganbayan has upheld the validity of the charge of violation of the Anti-Graft and Corrupt Practices Act (RA 3019) filed on October 14, 2025 against former Department of Energy officials led by former Secretary Alfonso Cusi.
The anti-graft court’s decision dated March 4, 2026 denied separate Motions to Quash and Motions to Dismiss filed by the defendants alleging the facts as alleged in the information do not constitute a criminal offense.
Aside from assigning defects to the information, they also argued that the basis for criminal liability has been extinguished when President Ferdinand Marcos Jr. approved the renewal of Service Contract No. 38 as it supposedly “implies that the consortium is deemed legally, technically, and financially qualified to operate the Malampaya project.”
