The Income Tax Appellate Tribunal (ITAT) Bangalore has ruled capital gains from sale of a property gifted by husband to his wife should be taxed in husband's hands, not the wife's.

A bench of Vice President Prashant Maharishi and Judicial Member Soundararajan K said clubbing provisions under Section 64(1)(iv) of the I-T Act apply in such cases, leaving "no option either with assessee or with Revenue" to tax income in the recipient's hands.
