SC questions Kerala HC's 'regular practice'

|September 09, 2025
EXPRESSING concern over the "regular practice" of the Kerala High Court entertaining anticipatory bail pleas without asking plaintiffs to first approach trial courts, the Supreme Court on Monday said this does not happen in any other high court.
There is a hierarchy provided in the Code of Criminal Procedure (CrPC) and the Bharatiya Nagarik Suraksha Sanhita (BNSS), a two-judge bench, comprising Justices Vikram Nath and Sandeep Mehta, said.
The SC made the remark while hearing a bail petition filed by a man accused of raping a minor.
In March, the Kerala HC had rejected the plea of Mohammed Rasal C.
