J'Khand HC seeks fresh probe into 262 custodial deaths, cites 'disregard for law'

THE Jharkhand High Court on Thursday delivered a landmark judgment on custodial deaths and constitutional accountability, ordering fresh judicial inquiries into 262 custodial death cases after finding that inquiries were conducted by Executive Magistrates instead of Judicial Magistrates, violating Section 176(1-A) of the Code of Criminal Procedure and Section 196(2) of the Bharatiya Nagarik Suraksha Sanhita.
The order was passed by a Division Bench of Chief Justice MS Sonak and Justice Rajesh Shankar while hearing a PIL filed by Md Mumtaz Ansari. The petition raised concerns over failures in following proper procedures for investigating custodial deaths across Jharkhand.
