SC issues notice to EC on petition seeking repoll if NOTA gets majority

THE Supreme Court on Friday served a notice on the Election Commission of India (ECI) on motivational speaker Shiv Khera's PIL seeking a direction to declare an election "null and void" if maximum votes from the constituency are polled for "None of The Above" (NOTA).
After hearing lawyer Gopal Sankaranarayanan appearing for Khera, a bench led by CJI DY Chandrachud said a notice would be served on the EC.
"This is about the electoral process. Let us see what the election commission has to say on this," he said.
Sankaranarayanan cited the recent Surat example, where no election was held as there was only one BJP candidate who won unopposed.
