Supreme Court Relaxes Conditions to Appoint ad hoc Judges in High Courts, Says Vacancies Need Not Be More Than 20%

The Supreme Court on January 30, 2025, relaxed the conditions to appoint ad hoc judges in High Courts.

The Supreme Court kept in abeyance the condition in its judgment dated April 2021 that ad hoc judges as per Article 224 of the Constitution of India can be appointed only if the vacancies are more than 20% of the sanctioned strength.
The Article 224A of the Constitution of India stated that the retired High Court judges can be appointed as High Court Judges.
The bench comprising of Chief Justice of India Sanjiv Khanna, Justice BR Gavai and Justice Surya Kant was hearing the present matter.
