Kerala High Court Dismissed PIL Alleging Rajeev Chandrashekhar Filed False Affidavit Ahead Of Lok Sabha Polls: 'Remedy Is Election Petition'

The Kerala High Court in the case Avani Bansal v The Election Commission of India observed and has dismissed the public interest litigation, PIL wherein it alleged that no action has been taken on the complaint stating that a false affidavit has been filed along with the nomination paper by BJP leader and Union Minister Rajeev Chandrashekar.

The bench comprising of Justice V G Arun and Justice S. Manu in the case observed and has refused to invoke the writ jurisdiction. The bench stated that its hands are 'tied' as the election process has already been commenced.
The court stated that the said court is of the opinion that whether Returning Officer should have considered the complaint and pass reasoned order cannot be considered at this stage and the remedy of the petitioners if they are aggrieved by the affidavit filed a candidate is to file an election petition.
The petitioner, Advocate and Congress Leader Avani Bansal alleged before the court that Minister Rajeev Chandrashekar suppressed his financial assets and misrepresented the income of him in the affidavit filed along with his nomination paper.
