UNFAIR EXECUTIVE DISMISSALS UNDER DEBATE

THERE is also much debate about the unfair dismissals of executives and high earning individuals. Up until now, all employees are entitled to the same pre-dismissal rights.

The suggestion from Nedlac has been to take some of those labour law rights under the Labour Relations Act away from high paid executives.

The amount debated is 1.8 million rand per annum. Again, this is not law as yet but has been strongly recommended by the parties to Nedlac including organised business, organised labour and government.

This will mean that the system at the CCMA and the Labour Courts will be freed from a lot of wasted time and energy on highly paid executives who could quite easily afford to go directly to the Labour Court or to the High Court in South Africa.

These individuals can afford lawyers and can litigate at their own leisure. This is a good move in that it has been found by the CCMA that much of their time is taken up with lengthy arbitrations engineered by highly paid executives.
