'Liberty cannot be denied on technicalities': SC slams UP govt over delay in prisoner's release, orders judicial inquiry & compensation

In a stinging rebuke to the Uttar Pradesh government, the Supreme Court on Wednesday ordered a judicial inquiry and directed the State to pay 5 lakh as interim compensation to a man who was kept incarcerated for 28 days despite a valid bail and release order, calling it a "travesty of justice" and "a matter of liberty."
Ordering a probe by the Principal District & Sessions Judge, Ghaziabad, into the delay in the prisoner's release despite clear bail/release orders, a vacation bench of Justice K V Viswanathan and Justice Nongmeikapam Kotiswar Singh questioned whether vested interests had played a role in the continued incarceration of the accused.
The Court requested the Chief Justice of the Allahabad High Court to designate the Principal District and Sessions Judge, Ghaziabad, to conduct the inquiry and submit a report by 18 August, 2025 – the next date of hearing.
