Former Chief Justice of India BR Gavai on Friday cautioned that prolonged criminal proceedings in free speech cases can themselves become a form of punishment, often causing harm that cannot be undone even if the accused is eventually acquitted.
Speaking at the Justice KT Desai memorial lecture at the Bombay High Court, he said that delays at any stage of investigation, trial or appeal can severely damage a person's liberty, reputation and ability to express themselves freely.
