Foreign Courts Cannot Annul Hindu Marriages Solemnized in India: HC

In a landmark judgment reinforcing the sanctity of Indian personal laws, the Gujarat High Court has ruled that marriages performed under the Hindu Marriage Act (HMA) in India cannot be annulled or dissolved by foreign courts, even if the couple resides abroad or has acquired foreign citizenship.

A division bench comprising Justice A.Y. Kogje and Justice N.S. Sanjay Gowda categorically stated that disputes arising out of Hindu marriages conducted in India must be adjudicated strictly under the Hindu Marriage Act. The court clarified that foreign family laws cannot override the Indian statute.
