SUPREME COURT DISMISSES PLEA SEEKING TO PERMIT ARRESTED POLITICIANS TO CAMPAIGN THROUGH VC; KEEPS QUESTION OF LAW OPEN

The Supreme Court in the case Amarjeet Gupta Versus Election Commission Of India And Ors observed and has dismissed the Special Leave Petition, SLP seeking a direction against Election Commission of India, ECI to ensure that arrested political leaders are allowed to campaign via virtual conference mode.

The court in the case orally remarked that petition has been filed with ‘malafide intentions.’
The Delhi High Court bench comprising of Chief Justice Manmohan and Justice Manmeet PS Arora in the case dismissed the same, wherein it is stated that it is a highly adventurous plea, contrary to fundamental principles of law.
Against this backdrop, the present SLP was filed before the Supreme Court.
The bench comprising of Justice Surya Kant and Justice Ujjal Bhuyan stated that the entire pleading concentrated on one particular person.
The court stated, why are you concentrating with respect to one person your entire pleadings are referring to one particular political person who himself is capable of coming to court...battery of the lawyers are for him.
