Punjab and Haryana High Court grants pre-arrest bail to author of book on Sidhu Moosewala in defamation case: 'Homage' to deceased singer

The Punjab and Haryana High Court in the case Manjindersingh @Manjindermakha Versus State Of Punjab observed and has granted an anticipatory bail to the author of a book based on deceased Punjabi singer Sidhu Moosewala's life account, in a defamation case.

In the present matter, a complaint was filed by Moosewala's father against the author-Manjinder Singh who wrote the book 'The Real Reason Why Legend Died' under section 451, section 406 (criminal breach of trust), and section 380 (theft) of the Indian Penal Code, IPC along with Section 356(3) of the Bharatiya Nyaya Sanhita, BNS, wherein it alleged that it contains defamatory material against singer's family.

The bench headed by Justice Sandeep Moudgil stated that, 'There being no valid or cogent reason to deny the bail to the present petitioner as the book is a legitimate personal account or homage to Sidhu Moosewala, written by someone who knew him personally, and it was not a case of intellectual property theft.'
