Supreme Court Allows Appeal Against Retrospective Application Of Electricity Act, 2003

The Supreme Court in the case The Madhya Pradesh Madhya Kshetra Vidyut Vitran Company Limited And Ors versus. Bapuna Alcobrew observed and has allowed the appeal wherein the Special leave petition is filed against the judgement of Madhya Pradesh High Court dated October 13, 2011.

In the present case, the petition filed raised a substantial question of law before the court that is, whether Section 56(2) of the Electricity Act, 2003 shall apply on the bills issued which being only in respect of the dues which arose in terms of the Electricity Act, 1948, as was applicable prior to coming into force of the 2003 Act.
The Appellant in the case raised a demand which amounted to Rs. 70.50 lacs vide a showcase dated January 7, 2009.
