Orissa High Court: Information Related To Outcome Of Tax Evasion Petition Sought Under RTI Act Cannot Be Provided

The Orissa High Court in the case Deepak Kumar Acharya Versus Commissioner, Income Tax Dept and others observed and has held that information which relates to the outcome of a tax evasion petition seeking under the Right to Information Act cannot be provided.

The bench comprising of Justice B.R. Sarangi and Justice G. Satapathy in the case observed that that the claim of the petitioner with regards to the supply of information sought in the application filed under the Right to Information Act is not permissible in view of the provisions contained as stated under clause (i) of Section 8(1) of the Right to Information Act.
It has been stated under section 8(1)(i), that there shall be no such obligation to give any citizen cabinet papers, which includes records of the deliberations of the Council of Ministers, Secretaries, and other officers.
