J&K Wakfs Act 1978 overrides other laws

The Jammu and Kashmir and Ladakh High Court in the case Baldev Singh Vs State of Jammu & Kashmir observed and has ruled that the Jammu and Kashmir Wakfs Act, 1978 overrides all other laws when it comes to Wakf properties.

The bench of Justice Javed Iqbal Wani in the case observed that shedding light on the status of Acts which are inconsistent with the Waqf Act.
The court stated that the Act of 1978 and of the rules and orders made thereunder shall have overriding effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any such law.
In the present case, the petitioners Baldev Singh and Rajinder Jeet Singh wherein challenging the validity of SRO 95 dated March 19, 1981, which designated a particular land as Wakaf property.
